Land Dispute: Court Rules In Favour Of Omo Amadasun

A Benin High Court has issued a certificate of execution of warrant of possession with Appropriate General Title ” A”to Mr Frank Omo Amadasun who is the claimant and owner of parcel of land measuring 200 feets by 300 feets situated at Evbukhu in Oredo Local Government Area of Edo State.

The parcel of land is described in survey Plan Number ASE/ ED/338/2011 as acquired by Mr Frank Omo Amadasun, the claimant.

The certificate of the warrant of possession signed by M.O Okoeguale with form number ESMDC 38/WP/2024 is to be executed and implemented with immediate effect as the court has since given a judgement in favour of Mr. Frank Omo Amadasun.

The court presided over by Hon. Justice M.E Itsueli heard that both parties to the landed property had earlier entered an agreement at the Edo State Private Property Protection Committee and prepared at the Edo State Multi Indoor Court House on 10th July, 2024 and signed by the parties involved.

The court also heard from the claimant that his parcel of land measuring 200 feets by 300 feets at Evbukhu in Oredo Local Government Area of Edo State had been encroached upon by an unidentified person.

Based on the petition by the claimant to the Edo State Property Protection Committee, Amagba lduwe Akengbuda representatives then agreed with the claimant that the matter be referred to the EDO State Multi Indoor Court House for ratification of the agreement reached at the Private Property Protection Committee.

In the settlement statement, both parties agreed that the claimant, Mr Frank Omo Amadasun is the lawful owner of the parcel of land in issue.

Both parties also agreed that the respondent shall remove all forms of encroachment from the claimant ‘s parcels of land and also resolved that the resolution shall be binding on all parties, their heirs, assigns, executors, personal representatives and successors in title.

Hon. Justice M.E ItsueliI later adopted the resolution and agreed as consent judgement of the court.

With this Benin High Court judgment, Mr Frank Omo Amadasun is set to take full possession of his landed property measuring 200 feets by 300 feet situated at Evbukhu, Oredo Local Government Area of Edo State as two weeks ultimatum with effect from 4th April, 2025 has been given to occupants of the property to vacate immediately.
